If you and your spouse do not agree on all of the issues surrounding a divorce, or to even get divorced in the first place, whoever is the first to draft a Summons and Petition becomes the Petitioner and serves it on the Respondent. The Summons and Petition is the first document in a divorce that lays out the particulars about the divorce and how the party wishes to proceed. Generally, contested divorces take longer to settle because they require more court appearances and work from both sides. However, if both sides are able to come to an agreement, they can file a “Stipulation” form to finish the case.
