If you have already created a trust that all of your assets will become part of after you die, a pour-over will may be helpful in order to make sure that any of the assets that may have been forgotten in the trust will be treated the same. If you do not have a pour-over will, all assets that are not included in the trust will be subject to probate after your death. Therefore it is important to create a pour-over trust so that your assets will “pour-over” into the trust you had already created.
