I am concerned they will lie. Should I write the judge? Should I meet with them in person, go to the FBI and the U.S. Attorney for arrests?
Navigating a Difficult Situation
Well, this is a really frustrating situation. If you are dealing with a dishonest, unscrupulous opposing party, what are you to do? You can work with law enforcement. You can work with your attorney to try to expose them as liars. There are a number of attorney techniques that we use when getting a party on the stand or in a deposition. Once a person starts making lies, you can often expose those lies. I won’t go into the details here. There is plenty of information online about how attorneys can expose dishonesty in a deposition or on a stand. I actually love it when the other side starts lying. One of the best ways to get in trouble in a lawsuit is to start lying because now the judge doesn’t believe a word you have to say. So I love it when the other side starts lying, and I tell my clients, “Whatever you do, tell the truth. And if you have a concern about telling some truth now, let’s talk about it in advance and deal with it. But the last thing you want to do is lie in court.” So I would say, “If the other side is lying, you and your attorney might celebrate because now they have given you a gift that you can reveal them as the bad party and the party who should lose in a case.”
Exploring Options for Justice
You do have a right to also contact law enforcement, but unless somebody is at risk of physical harm or some sort of serious financial fraud, law enforcement often doesn’t like to get involved in this kind of stuff. The federal government gets told about million-dollar frauds all the time. So usually, it has to be a huge situation for federal law enforcement like the FBI, or even the attorney general’s office, to get involved. So unfortunately, it is often up to you to use the court system and your own attorney to get justice when somebody else has hurt you.
